Terms of sale

1. Who sells

The seller is Scopelliti 1887 S.r.l., a single-member company, with registered office at Via Fata Morgana 52, 89125 Reggio Calabria (RC), entered in the Reggio Calabria Register of Companies, REA RC-145085, share capital € 100,000.00 fully paid up, VAT no. 2. What you are buying here

This site hosts the maison’s lists. Whoever takes part in a list buys a piece chosen by the recipients, a share of one, or makes an open contribution to the list. You are not buying a voucher: the amount is the price of the goods, or of the part of the goods, that the recipients will receive.

The maison’s general catalogue remains on scopelliti1887.com, with its own terms of sale: purchases made there are not governed by this page.

3. Consumers and traders

A consumer is a natural person acting for purposes outside their business, commercial, craft or professional activity (art. 3 of the Italian Consumer Code). The protections described on the Right of Withdrawal and Returns page and the legal guarantee of conformity are owed to consumers. Anyone purchasing under a VAT number acts as a trader, and those protections do not apply unless otherwise agreed.

4. How the contract is concluded

The contract is concluded when the order reaches our systems and the payment is authorised. You will receive a confirmation by email at the address you gave. Before you pay you are shown a summary with the piece, the amount and, where applicable, the delivery method: please read it again.

5. Prices

Prices are in euro and include VAT. Amounts and totals are always calculated by our systems at the time of the order: the value shown before payment is the one that will be charged. Delivery costs, where due, are set out separately on the Shipping and Delivery page.

6. Payments

Payments are handled by PayPal. Card details are entered on the payment provider’s pages and neither pass through nor are stored on our systems. Confirmation of payment comes from the payment provider: until it arrives, the order remains pending.

7. Availability

Pieces from the maisons we represent are limited in number and some are made or decorated by hand. Should a piece prove unavailable after the order, we will contact you to agree a longer delivery time, an equivalent piece or the return of the amount: the choice is yours.

8. Delivery, withdrawal and guarantee

Delivery times, methods and costs are described in Shipping and Delivery. The right of withdrawal and the returns procedure are described in Right of Withdrawal and Returns. Goods bought by a consumer carry the two-year legal guarantee of conformity from delivery (arts. 128 and following of the Italian Consumer Code).

9. Shares and contributions that do not complete a piece

A share is part of the price of a piece: it may happen that, when the list closes, the shares collected on a piece do not cover its full price. In that case the amount already paid is retained and the recipients use it with the maison, towards completing that same piece or towards other goods from the maisons we represent. No automatic refund to the participants is provided for.

This does not affect your right of withdrawal: within the fourteen days you may always exercise it on the terms described in Right of Withdrawal and Returns.

10. Complaints and dispute resolution

For any complaint, write to us at shop@scopelliti1887.com or call us on +39 0965 374441: we reply during boutique hours. If the complaint is not resolved, a consumer may turn to an alternative dispute resolution (ADR) body among those listed on the Italian ministerial registers. Recourse to the courts always remains available.

11. Governing law and jurisdiction

The contract is governed by Italian law. For consumers, the competent court is that of their place of residence or elected domicile, and the mandatory rules of their country of residence in the European Union continue to apply. In all other cases the court of Reggio Calabria has jurisdiction.

12. Changes

We may update these terms. The version published at the moment you placed your order always applies to it, bearing the date shown at the top of this page.
